A pesar de cualquier otra ley general o especial que diga lo contrario, el departamento de escuelas p\u00fablicas pondr\u00e1 en el IEP de los individuos la colocaci\u00f3n de tratamiento residencial 24\/7 y\/o la colocaci\u00f3n fuera del distrito escolar, una vez que el centro de atenci\u00f3n de salud mental profesional haya determinado que \u00e9l o ella es elegible para recibir tratamiento en un centro de tratamiento residencial 24\/7 y\/o la colocaci\u00f3n fuera del distrito escolar. Este IEP se celebrar\u00e1 en un plazo de 10 d\u00edas una vez que el centro de atenci\u00f3n de salud mental profesional haya determinado que el interesado re\u00fane los requisitos para recibir el tratamiento necesario. Los padres y tutores participar\u00e1n en la selecci\u00f3n de la colocaci\u00f3n de su hijo y tendr\u00e1n la autoridad final sobre la colocaci\u00f3n de tratamiento residencial y\/o fuera del distrito escolar a la que asistir\u00e1 su hijo una vez aceptada la colocaci\u00f3n de tratamiento residencial y\/o fuera del distrito escolar.<\/span><\/p>\n\n\n\n<p><span class=\"has-inline-color has-very-dark-gray-color\">SECCI\u00d3N 2. A pesar de cualquier ley general o especial que diga lo contrario, el departamento escolar, el departamento de servicios de desarrollo coordinar\u00e1 la financiaci\u00f3n con el departamento de ni\u00f1os y familias y el departamento de salud mental para asegurar la colocaci\u00f3n de servicio residencial y\/o la colocaci\u00f3n fuera del distrito escolar dentro de los 30 d\u00edas para los ni\u00f1os con discapacidades intelectuales una vez que el centro profesional de atenci\u00f3n de salud mental haya determinado que son elegibles para recibir este tratamiento necesario. Estos departamentos determinar\u00e1n la financiaci\u00f3n de la colocaci\u00f3n residencial y\/o la colocaci\u00f3n en un distrito escolar y no tendr\u00e1n ninguna relaci\u00f3n ni retraso en la recepci\u00f3n del ni\u00f1o de la colocaci\u00f3n residencial 24\/7 y\/o la colocaci\u00f3n en un distrito escolar para su tratamiento m\u00e9dico necesario y sus derechos a recibir una educaci\u00f3n adecuada.<\/span><\/p>\n\n\n\n<p><span class=\"has-inline-color has-very-dark-gray-color\">Se establecer\u00e1 una comisi\u00f3n especial para examinar e informar sobre la viabilidad de crear un fondo de emergencia para la colocaci\u00f3n oportuna y el pago de un ni\u00f1o discapacitado en un centro de atenci\u00f3n residencial y\/o la colocaci\u00f3n fuera del distrito escolar. Esta comisi\u00f3n evaluar\u00e1 las opciones y preparar\u00e1 las recomendaciones de pol\u00edtica necesarias para hacer frente a los retrasos en el pago y la colocaci\u00f3n en el actual sistema de atenci\u00f3n de la salud, para reformar la actual determinaci\u00f3n del proceso de pago y para establecer un medio m\u00e1s eficiente y oportuno para proporcionar la atenci\u00f3n adecuada a los ni\u00f1os con discapacidades de desarrollo. Esas recomendaciones incluir\u00e1n opciones de pol\u00edtica relativas a lo siguiente:<\/span><\/p>\n\n\n\n<p><span class=\"has-inline-color has-very-dark-gray-color\">i) Posibles ahorros para el Commonwealth y mejoras en la prestaci\u00f3n de cuidados que podr\u00edan realizarse reduciendo el tiempo que transcurre entre el pago y la colocaci\u00f3n; ii) mejoras en el sistema de reembolso sanitario masivo para los centros de atenci\u00f3n residencial; y iii) cualquier otra recomendaci\u00f3n que sea necesaria para atender m\u00e1s eficazmente a los ni\u00f1os con discapacidades del desarrollo en los procesos de pago y transferencia en el Commonwealth.<\/span><\/p>\n\n\n\n<p><span class=\"has-inline-color has-very-dark-gray-color\">La comisi\u00f3n estar\u00e1 compuesta por 6 miembros, uno de los cuales ser\u00e1 el secretario de salud y servicios humanos o una persona designada, los dos presidentes de la comisi\u00f3n mixta sobre ni\u00f1os, familias y personas con discapacidad o sus designados, que actuar\u00e1n como copresidentes; uno de ellos ser\u00e1 el director de Salud P\u00fablica o una persona designada, uno de los cuales ser\u00e1 el presidente del senado de la comisi\u00f3n mixta sobre la financiaci\u00f3n de la atenci\u00f3n de la salud o una persona designada, uno de los cuales ser\u00e1 el presidente de la c\u00e1mara de la comisi\u00f3n mixta sobre la financiaci\u00f3n de la atenci\u00f3n de la salud o una persona designada.<\/span><\/p>\n\n\n\n<p><span class=\"has-inline-color has-very-dark-gray-color\">La comisi\u00f3n se reunir\u00e1 en un plazo de 60 d\u00edas a partir de la aprobaci\u00f3n de la presente ley, y no menos de trimestralmente a partir de entonces, y emitir\u00e1 recomendaciones finales al Presidente del Senado, al Presidente de la C\u00e1mara, a la Comisi\u00f3n Conjunta de Ni\u00f1os, Familias y Personas con Discapacidades a m\u00e1s tardar un a\u00f1o despu\u00e9s de la aprobaci\u00f3n de la presente ley.&nbsp;<\/span><\/p>","protected":false},"excerpt":{"rendered":"<p>SECTION 1.
